Jersey Mediation Scheme is set to Expand

Wednesday 17th August 2011 | Sebastian David Lees

Mediation in Jersey is set to take another step forward with the expansion of Jersey’s mediation programme. In Jersey, parties with disputes would previously go to trial in the Royal Court but now they have the power to opt for alternative dispute resolution.

Mediation has already been introduced to Jersey's Petty Debts Court where it has been a popular alternative to court proceedings and two thirds of cases are now solved via ADR before they go to trial.

The scheme has been widened so that the success can be reproduced in the Royal Court with judges encouraged to refer parties to mediation. So far feedback on the scheme has been positive all around with reduced costs and greater satisfaction with the outcome of disputes reported.
